Florida bill will make diners refuse to automatically meet bad services

Florida lawmakers are considering a bill that could shake statewide restaurant dumping policies. If passed, HB 535 will allow diners to refuse automatic comfort or service charges if they believe the service is unsatisfactory. Additionally, automatic remuneration or service charges are only applicable to more than six parties. The bill also includes transparency requirements that require restaurants to disclose who receives remuneration or service fees and provide a percentage breakdown. The Florida Restaurant and Accommodation Association opposes the amendment, deeming service fees as “a key tool to ensure service and success.” A recent Wallethub survey found that 83% of Americans believe that automated service fees should be banned, while nine in 10 believe that tips have been “out of control”. Social media platforms, Reddit in particular, have been discussed on “Tip Fatigue,” with many users expressing their frustration about tip expectations at places that have traditionally been unnecessary. If approved, the law will come into force on July 1, 2025.
