A federal appeals court has upheld a jury's finding that former President Donald Trump sexually abused author E. Jean Carroll and denied Trump's request for a new trial. The ruling reaffirms a $5 million civil judgment awarded to Carroll earlier this year. Trump challenged the verdict, claiming the trial judge made serious errors, including allowing testimony from two other women who had accused him of sexual assault. However, the Court of Appeal held that the trial judge acted within his discretion. Even if any errors were made, the court concluded they were not significant enough to affect Trump's rights or require a new trial. “We appreciate the Second Circuit's careful consideration of arguments from both sides,” Roberta Kaplan, Carroll's attorney, said in a statement. Carroll alleges that Trump was arrested at a high-end Manhattan department store in the 1990s. Company Bergdorf Goodman raped her. She also claimed that Trump defamed her when he denied the accusations, saying she was not his type and accusing her of making up stories to promote her book. In the civil trial, a jury found Trump liable for sexual abuse, within the law. The lawsuit was filed under the New York State Adult Survivors Act, which was passed in 2022 and gives adult survivors of sexual assault a year to file civil claims, even in addition to a $5 million award for sexual abuse. In addition, another jury recently awarded Carroll $83.3 million in damages because Trump defamed her by publicly denying sexual abuse. Trump also appealed the verdict. Notably, these are civil cases, meaning Trump will not face jail time as a result of the verdict. He continues to deny all accusations of wrongdoing, insisting Carroll's claims are false.
