A federal appeals court ruled Friday that the Deferred Action for Childhood Arrivals (DACA) program is illegal, casting uncertainty over the futures of more than half a million immigrants brought to the United States illegally as children. The Fifth Circuit upheld a lower court's ruling that the Biden administration's efforts to codify DACA violated U.S. immigration law. The original Obama-era memo creating DACA was also ruled illegal. While the ruling could have far-reaching consequences, it won't immediately change the current status quo. The court suspended the order, allowing DACA to remain in effect for current beneficiaries but closing the door to new applicants. The program was created in 2012 to protect immigrants who entered the U.S. illegally or overstayed their visas as minors, known as “Dreamers,” from deportation. The ruling affects only Texas, the state where Republicans led the lawsuit against DACA. The court allowed current beneficiaries to continue the renewal pending further action by the Fifth Circuit or the Supreme Court. That could lead to a final ruling on DACA, although it's uncertain how President Trump's incoming administration will handle the case. Texas Attorney General Ken Paxton celebrated the ruling as a victory, while immigration advocates condemned it as an attack on young immigrants.
